What We Offer
Our Wills, Trust and Probate team continues to go from strength-to-strength.
From dealing with the simplest of wills to the most complex of cases, we aspire to provide the very best, tailored and practical advice in a relevant, respectful and confident manner.
Succession Planning and Capital Taxation
We offer a full range of inheritance tax and capital gains tax planning. This includes tax mitigation in life, in death and after death through the use of deeds of variation and disclaimers.
Probate is the legal process of dealing with the estate of a deceased person. We offer a bespoke service that is professionally tailored to your particular needs.
This includes obtaining the grant of probate, only up to the full administration of the estate. In some cases, it can even include making the funeral arrangements. Our Department has special expertise in complex estates and is frequently asked by other solicitors to handle difficult cases. We also deal with many cases where there is no will (intestacy) or insufficient assets to meet all the debts (insolvent estates).
Protection is the key word here. Whether to reduce your tax bill, protect a vulnerable beneficiary or ensure that the family silver is safeguarded - we offer our clients a full range of trusts. This includes discretionary, flexible life interest, occupation rights, asset protection and simple bare trusts.
Often overlooked, wills are the cornerstone of any good estate planning as well as holding a certain sentimental value. They secure the estate for our loved ones, help eliminate unnecessary tax and manage what can be rather complex modern family relationships.
We are often asked to take on the role of executors and offer a completely free, and completely secure will storage service.
The will-making process is thorough but efficient with a typical case taking no more than two weeks from the first contact to signing and even faster in emergency situations.
Court of Protection
If mental incapacity strikes unexpectedly and a power of attorney cannot be given, then the course of action for managing finances and health matters is through the Court of Protection.
This may sound daunting, but we have many years of experience in handling applications to the Court and are here to help you through every step of the way. The Partners in the Firm often act as Deputy or Attorney managing an incapable client’s financial and health affairs on a day to day basis.
This can mean anything from overseeing the investment of house sale monies and looking after pets, to accompanying our client on a trip to the Doctor’s Surgery.
We help new charities deal with the creation of their governing documents and registration with the Charity Commission. We also manage the legal affairs of a number of Charities.
We look forward to discussing how Tolhurst Fisher can help you or your business.
