Paul recently acted for a developer purchasing land for residential development which was subject to a restrictive covenant which limited the density of development to a single residential dwelling. Having investigated the titles and the history of the adjoining properties Paul was able to establish that the covenant had already been breached on several occasions by adjoining properties and that the likelihood of a claim was sufficiently slim for the risk to be covered by insurance. This then enabled the developer to proceed with the acquisition of the site and to obtain planning permission for numerous dwellings.
