Conveyancing timescales

The legal process of buying and selling property is arguably, the most important part of the property transaction.  It is also, at times, the most misunderstood part of the process. For buyers, sellers, estate agents and mortgage brokers, every day is a step closer to completion. During this time, we, as solicitors, are focusing on complex legal checks, searches, and coordinating all parties including lenders, local authorities and other solicitors.  This is all to ensure that every detail is correct.

We at Tolhurst Fisher appreciate that property transactions can be one of the most stressful process to go through. However, we do adopt a meticulous, cautious and thorough approach in order to protect our clients from experiencing legal issues in the future and to ensure, in respect of property purchases, that the property is the right property for our clients and a good investment from a legal perspective and this can take time.

Generally,  a straightforward conveyancing transaction can take between 8 and 12 weeks but this is not guaranteed and is only guide. Delays can arise from many factors which are out of anyone’s control.  Some examples of such factors are listed below but this is not an exhaustive list:

  • Complex legal issues
  • Slow search results
  • Outstanding mortgages and dealing with lender requirements
  • Long chains
  • Breaks in chain
  • The involvement of tenanted/rental properties
  • Last-minute queries.

None of these or any other factor reflect a lack of effort.  They only go to show how many moving parts can be involved in property transactions.

We try to manage expectations from the outset and to provide honest timelines as far as we can. Estate agents also play a vital role in keeping communication clear and clients reassured, especially when progress seems slow.

Ultimately, successful conveyancing is built on trust, communication, and patience. When everyone works as a team and appreciates each other’s pressures and priorities, the process is more likely to becomes less about frustration and more about progress and collaboration. The goal for everyone is a safe, smooth, and successful move.
