Akanshi has over 10 years post qualified experience as a solicitor.  She trained with a West-End London firm, moving to a regional firm in Kent working from its City of London office for 5 years before moving to Tolhurst Fisher in April 2018.  Akanshi became a Partner in the Dispute Resolution Department in November 2018.

Case Studies
1. A client with significant land in Essex was having difficulty with a neighbour in respect of the boundary line between the properties and trespass, notwithstanding previous Court action.  Akanshi prepared a robust application to strike out the claim issued against her client, which was successful and obtained an injunction against the neighbouring owners preventing them from interfering with the client’s land.  Had the Claim been allowed to progress, this would have resulted in lengthy and expensive litigation which would have lasted no less than 2 years and cost the client over £150,000 and the neighbouring owners would have continued to interfere with the land.  This was avoided as a result of Akanshi’s in-depth knowledge of the Civil Procedure Rules and progressing matters quickly.

2. Acting for a partner in a GP medical practice who was in dispute with the other partner, it was thought to be impossible for the parties to reach a solution given the breakdown in the relationship.  Proceedings had been on-going for a number of years, however, Akanshi having undertaken a thorough review of the matter, was able to strengthen the client’s position which resulted in the scales tipping in favour of the client.  This focused the parties’ attention to the risks of the Trial and the further costs which would be incurred by the parties in the accounting exercise, which ultimately resulted in a settlement.  This meant that the client benefited from the certainty of an outcome and could avoid expending further time, resources and costs in the matter.

3. An executor and beneficiary of an estate was prevented from administering the estate by a relative who had entered a caveat at the Probate Registry as it was alleged that either the deceased did not have capacity to make the last Will and Testament or was unduly influenced.  This prevented the client from obtaining what was left to her under the Will.  Akanshi collated and reviewed all of the necessary documentation, including medical evidence and obtaining written statements from witnesses in response to the allegations, and issuing a Warning, exerting pressure on the caveator to remove the caveat.  This ultimately resulted in the caveator conceding, removing the caveat, enabling the client to proceed with the administration of the estate.
